These Terms of Service ("Terms") apply to your use of the Australian Firefighters Prints website, products and services.

Australian Firefighters Prints ("AFP", "we", "us" or "our") is operated by Transparent Tracks Pty Ltd, trading as Australian Firefighters Prints, in collaboration with the Australian Firefighters Calendar.

By accessing our website, uploading photographs, placing an order or otherwise using our services, you agree to these Terms and our Privacy Policy and Refunds & Returns Policy.

1. OUR SERVICE

Australian Firefighters Prints allows customers to create personalised images featuring participating Australian Firefighters Calendar firefighters.

Depending on the product purchased, the process may include:

  • choosing a participating firefighter;
  • selecting who your uploaded photographs depict;
  • uploading reference photographs;
  • automated assessment of uploaded photographs;
  • creation and refinement of personalised images using automated and artificial-intelligence image processing;
  • delivery of 10 personalised digital images;
  • selection by you of one personalised image; and
  • production and delivery of that selected image as a personalised acrylic product.

The exact products, sizes, inclusions and prices available will be shown on the website at the time of purchase.

2. UPLOADED PHOTOGRAPHS AND PERMISSIONS

You must only upload photographs that you are legally entitled to use for the purposes described in these Terms.

By uploading a photograph, you represent and warrant that:

  • you own the photograph or otherwise have sufficient rights or permission to use it;
  • you have the necessary authority or permission from identifiable people depicted in the photograph;
  • your use of the photograph does not infringe another person's copyright, privacy, publicity, image, personality or other rights; and
  • you are authorised to allow AFP and its service providers to process the photograph for the purpose of providing your order.

If a photograph depicts a person under 18, you must be their parent or legal guardian, or otherwise have the appropriate permission and authority from their parent or legal guardian.

You must not upload photographs of unrelated children or other people whose images you are not authorised to use.

3. PHOTO AND IDENTITY PROCESSING

AFP uses automated systems to assess uploaded photographs and help create accurate personalised images.

Processing may include assessing:

  • image resolution and quality;
  • blur and visibility;
  • face visibility;
  • the number of people appearing in an image;
  • relevant appearance characteristics;
  • which photographs provide the strongest identity references; and
  • similarity between generated imagery and the person shown in the customer's reference photographs.

Some of this processing may involve facial comparison or biometric information.

Where required, AFP obtains express consent for this processing through the photo upload or ordering experience.

4. UNSUITABLE PHOTOGRAPHS

AFP may reject individual photographs that are unsuitable for creating personalised images.

Where possible, only the affected photograph will need to be replaced rather than the customer's entire photo set.

AFP may require additional or replacement photographs before an order can proceed.

Customers should provide clear, appropriate reference photographs and follow the upload guidance displayed on the website.

5. PERSONALISED IMAGE GENERATION

AFP uses artificial intelligence and other automated image-processing technologies to create and refine personalised imagery.

The process may include:

  • analysing approved reference photographs;
  • identifying relevant appearance characteristics;
  • selecting useful identity references;
  • inserting the intended person or pet into an approved firefighter scene;
  • protecting portions of the original scene from modification;
  • comparing generated facial identity with reference photographs;
  • performing additional facial or identity refinement where required; and
  • compositing the final personalised result.

Artificially generated imagery can contain natural variation.

AFP takes reasonable steps to create high-quality personalised results, but every generated image will not necessarily reproduce every aspect of a person's appearance exactly.

Natural differences in expression, lighting, pose, hair, clothing, body position and other visual characteristics may occur.

Nothing in this section limits rights available under the Australian Consumer Law.

6. YOUR 10 PERSONALISED IMAGES

Unless otherwise stated on the applicable product page, an AFP order includes 10 personalised digital images.

Once completed, all 10 images are made available to the customer to keep and download, subject to the personal-use licence in these Terms.

The customer then selects one of the images to be professionally printed on the acrylic product purchased.

AFP does not automatically choose a print image for the customer.

7. IF YOU DO NOT SELECT A PRINT

If you do not select an image for printing, AFP may send up to three reminders asking you to complete your selection.

After those reminders, AFP may archive the order workflow.

Archiving does not mean that AFP automatically selects or prints an image.

Where your images remain available under AFP's retention practices, you may return later, select your preferred image and continue with production.

8. ADDITIONAL GENERATIONS

Each new personalised image generation requires additional processing and third-party service costs.

If your original personalised set has been successfully supplied and you simply want another generation or a different creative interpretation, additional generations may be available for an additional charge.

A free regeneration is not automatically provided solely because a customer:

  • prefers another expression;
  • prefers another pose;
  • would prefer different styling;
  • wishes they looked different in a generated image; or
  • would simply like another creative interpretation.

Where there is a genuine technical or service failure, AFP will review the issue and provide an appropriate remedy where required.

Examples may include corrupted files, the incorrect customer being inserted, material technical processing failures or significant defects that prevent an image from reasonably functioning for its intended personalised purpose.

Nothing in this section limits Australian Consumer Law rights.

9. PERSONAL, NON-COMMERCIAL LICENCE

Subject to these Terms, AFP grants you a personal, worldwide, non-exclusive and non-transferable licence to use the personalised images supplied to you for personal and non-commercial purposes.

Permitted personal uses include:

  • keeping the digital files;
  • sharing them on personal social media accounts;
  • using them as profile pictures or device backgrounds;
  • privately printing them; and
  • giving personal copies as gifts.

Unless AFP has given prior written permission, you must not:

  • sell or license the personalised images;
  • use them on merchandise for sale;
  • use them in paid commercial advertising;
  • use them to promote a commercial business or service;
  • imply that a firefighter endorses a business, organisation, product, service or political cause;
  • use them for deceptive impersonation;
  • commercially tokenise or exploit the images; or
  • otherwise commercially exploit a participating firefighter's name, likeness or image.

10. FIREFIGHTER AND AUSTRALIAN FIREFIGHTERS CALENDAR RIGHTS

Participating firefighters, the Australian Firefighters Calendar and their respective licensors retain their rights in their names, likenesses, photography, trademarks, branding and other underlying intellectual property.

Purchasing an AFP product does not transfer ownership of those underlying rights to the customer.

The customer's rights in the final personalised images are limited to the licence described in these Terms.

11. CUSTOMER PHOTOGRAPHS

You retain any rights you hold in the photographs you upload.

You grant AFP and the service providers required to fulfil your order a limited right to host, reproduce, analyse, modify and process those photographs as reasonably necessary to:

  • assess suitability;
  • provide the personalised service;
  • create and refine your personalised images;
  • perform quality checks;
  • provide customer support;
  • investigate technical issues;
  • maintain the security of the service; and
  • comply with applicable law.

12. MARKETING USE OF CUSTOMER CONTENT

AFP does not automatically obtain the right to use customer photographs or personalised images in advertising or marketing merely because a customer places an order.

AFP will not use customer uploaded photographs or personalised generated images in advertising, public website galleries, paid social advertising, organic social media marketing or similar promotional activity unless AFP separately obtains the customer's express permission.

13. PROHIBITED CONTENT AND USES

You must not use AFP to upload, create or request material that:

  • is unlawful;
  • is sexually explicit or exploitative;
  • sexualises or exploits a minor;
  • is hateful, threatening or seriously harassing;
  • is defamatory;
  • deliberately humiliates or degrades another person;
  • promotes serious unlawful activity;
  • infringes intellectual property, privacy, publicity or personality rights;
  • falsely represents endorsement by a participating firefighter;
  • is intended to materially deceive others about a person's genuine conduct or statements;
  • contains photographs you are not authorised to use; or
  • otherwise seriously misuses the service or a participating firefighter's likeness.

AFP may reject, suspend or cancel processing where we reasonably believe an order violates these Terms, applicable law or the mandatory rules of a service provider required to fulfil the order.

14. ORDERS AND PAYMENT

Prices are displayed on the website and may change from time to time.

Customers must provide accurate billing, contact, delivery and order information.

An order may be cancelled where:

  • payment is unsuccessful;
  • fraud is suspected;
  • an order violates these Terms;
  • suitable required photographs cannot be provided;
  • a required technology provider prevents lawful processing; or
  • AFP is otherwise unable to fulfil the order.

Refunds will be handled in accordance with our Refunds & Returns Policy and applicable law.

15. CANCELLATIONS AND REFUNDS

Because AFP products and digital imagery are personalised and processing may begin soon after checkout, change-of-mind cancellations may be limited once personalised processing has commenced.

Any deduction or charge relating to work already performed will reflect personalised services or non-recoverable costs already incurred.

Nothing in these Terms excludes any rights available under the Australian Consumer Law.

16. CUSTOMER PRINT SELECTION

Once the customer selects their personalised image for physical printing, production may begin promptly.

The customer is responsible for confirming that the correct image has been selected.

After physical production has commenced, change-of-mind cancellation may no longer be available because the physical item has been personalised specifically for that customer.

This does not affect remedies available for faulty, damaged, incorrect or otherwise non-compliant products.

17. SHIPPING, DUTIES AND CUSTOMS

Delivery estimates displayed by AFP are estimates unless expressly stated otherwise.

International orders may be subject to customs duties, taxes, import charges or other local government charges.

Unless otherwise stated at checkout, these charges are the customer's responsibility.

Customs processes, delivery carriers and circumstances outside AFP's reasonable control may cause delays.

18. THIRD-PARTY TECHNOLOGY

AFP uses third-party technology providers to deliver parts of the service.

These may include ecommerce, hosting, storage, artificial-intelligence, image-analysis, facial-comparison and image-processing providers.

Those providers may process customer information as explained in our Privacy Policy.

AFP may change providers or processing methods where reasonably necessary, provided this does not remove rights customers already have for an existing order.

19. AUSTRALIAN CONSUMER LAW

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms limits or excludes any consumer guarantee, right or remedy that cannot lawfully be limited or excluded.

Depending on the circumstances, remedies may include repair, replacement, re-performance of services, refund, cancellation or compensation.

20. LIABILITY

To the maximum extent permitted by law, AFP is not responsible for indirect or consequential loss that was not reasonably foreseeable or which resulted from circumstances outside AFP's reasonable control.

Nothing in these Terms limits liability where doing so would be unlawful.

21. RESPONSIBILITY FOR UNAUTHORISED CONTENT

Where a third party makes a claim against AFP because a customer knowingly or negligently uploaded photographs or other material without the required rights or permissions, the customer is responsible for losses reasonably arising from their breach to the extent permitted by law and to the extent caused by their conduct.

This does not apply to the extent AFP caused or contributed to the relevant loss and does not limit non-excludable consumer rights.

22. CHANGES TO THESE TERMS

AFP may update these Terms from time to time.

The Terms applying to an order will generally be those in effect when the order was placed unless a change is required by law or benefits the customer.

23. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia.

Nothing in this section prevents customers from exercising rights available under mandatory consumer protection laws.
